Can I have that pearl necklace back now?

I keep looking at this thread title, and though I should really read through all the posts and possibly contribute to the discussion - I seem to have a little problem.

In my head, I keep hearing Butthead saying "Uhh, huh huh huh huh, he said 'Pearl Necklace' uh huh huh, huh huh huh huh" & Beavis saying "Yeah, yeah! That was cool! He rules!"

...and I haven't seen that show in a few years. Who says TV doesn't leave an impression?


Okay, read the news article....and wow. I'd throw this case out, though the man gets screwed on the deal (no pun intended). Of course, if it was normal sex - it's the woman's right to choose - so theoretically, we finally have reason to say that her legal right is a bunch of crap. Two conceivers, two people's choice.

Compared to these people & the laws regarding the topic - Beavis & Butthead seem much more reasonable. Who's up for a revolution?

And how many times did oral sex not result in pregnancy?/

You claim inevitability for a rare instance, pretty poor arguement if you ask me.

Nonsense. If the man voluntarily provided 'seed', then he is responsible for what 'sprouts'. He didn't know? Oh, please...

He approached the woman. He offered sex with the woman. He accepted sex from the woman. He obviously did not wear a condom, and did not keep track of his emissions. Negligence is no defense. Ignorance is bliss, but it won't stand up in court.

The man did not provide "seed." He merely engaged in consensual oral sex with the woman, which, unless some manipulation is done, cannot result in a child. We can therefore assume that he was not intending to have a child and purposely avoided coitus for this reason. His "seed" did not become the woman's property, but was merely the result of their consensual sex.
 
It seems obvious to me that he shouldn't pay child support, but I wonder what kind of standard that would set. Would a father not have to pay child support if the condom broke? How about if the woman told him she was infertile?

The law must get very strange when it has to account for crazy people...

Of course, you can ALSO get pregnant from nothing at all (and FL2 would be peculiarly well-versed on the single well-publicized example of that). However, I don't recall telling kids that they should not lead lives free from sin because they can get pregnant from it. ;)

see what happends when you live a good life, you get impregnated from nothing before you even get to have sex, and your kid acts like he's god. :lol:

I don't think he should, the first case should be a lawsuit against the condom company and the second is fraud on the womans part.

I still support my (progressive, not conservative) idea that men have no obligations to support the child at all (from a legal pov, not from a moral pov), unless the man and woman agreed (either on beforehand or afterwards) they will share the duties and rights that come the baby.

If I voluntarily stick a needle with drugs in my arm, it is my fault if I get really sick, not the drugs producer's, transporter's, nor retailer's fault.

People, men or women, are, imho, responsible for their own bodies.
 
Nope, condom companies are lot liable. There is a clear warning on each package that says that condoms are NOT 100% effective in preventing pregnancy or STD's. I am sure it was written by lawyers. ;)

So does that make the broken condom-wearer liable? I suppose they assume that the wearer knows its not 100% effective...

I've often wondered why there isn't mandatory STD testing (impracticality aside, I suppose), and in a more whimsical mood, why William F. Buckley's idea that everyone with AIDS gets a tattoo over their ass hasn't been instituted.

I don't even see how mandatory STD testing is really against individual rights, assuming the knowledge isn't stored in a database somewhere...

I'm pretty sure you don't get out of paying child support just by using a condom anywhere.

As regards veneric diseases, Swedish law makes it a crime for people with certain veneric diseases to have sex with others without telling them of their disease, but whether actual infection takes place is irrelevant in the eyes of the law (as is the use or non-use of condoms).
