Can't counterattack an enemy in 3rd party territory!

I have a stack of Mongolian Calvary outside my city, which I just took from the Russians a few turns ago. I am now at peace with Russia, but do not have Open Borders (and can't trade for it), but the Mongols can attack me. I have no recourse against their stack :-/
 
I realized that wasn't as clear as it could be :-)

The Russian border is adjacent to my city, and the stack of Mongol units is right next to the city but in Russian territory. The cat can reduce my city defenses but I can't do anything about it.
 
Go to war with the Russians and you can (or just negotiate Open Borders like your opponent did).
 
Um...I was 2 turns into a fresh peace treaty with Russia, and could not negotiate open borders due to relations.

Anyway, going to war with Russia is a bit more than I want; just a way to respond to incoming attacks.
 
Well, this wouldn't be a bug, just the way the game mechanics work. You need open borders with Russia, and apparently, they like your enemy better.
