Declare war bug?

Recently in a game I declared war on Boudica, while at the same time we both had an axeman in the same square. Shouldn't 1 of these axemen automove to a different tile, or shouldnt I at least be able to attack the axeman standing in the same tile as my axeman? Whats up witht that? Is it a big, or working as intended?
 
I would leave it as is. Automoving either of them would be exploitable.
 
If her man is in your lands, he should move: if yours is in hers, yours should move: both in neutral land, neither is forced to move, nor should they fight because an attack occurs when one unit attempts to move to the other's tile. You have a standoff; the first unit to move away can be attacked by the other, unless it can step off the common tile and back in the same turn.
Never had such a thing happen to me in all my years of civving !
 
I had this happen to me the other night (we were in neutral territory) - purely an accident of timing. But I immediately realized several ways to manipulate any of the alternatives to my advantage (especially involving forts in neutral territory. . . ).
