Your opinion only applies to common law judicial systems, the other form being civil law judicial systems.
Common law judges are allowed to create laws based on opinion, whereas civil judges cannot and, in a case, are supposed to be as specific as possible towards the case's ruling so that the ruling does not lead to other cases' rulings being biased.
I believe that we did have a discussion about which judicial system was to be used, although I do not believe we reached a conclusion. I was not that active at that time so I would not know.
