My attack sub with a spy onboard was passing through Hammurabi's territory, when I got a message saying that my spy was "stumbled upon" near one of his cities.

Next turn I check the sub, and what do you know - my spy has misteriously dissapeared!

Needless to say, this must be fixed. And though I haven't tested it yet, I strongly suspect it is the same story for all other types of transports (not just attack subs)

I guess the rival's coast guard noticed your sub, made it surface, searched it and found your spy hiding ;)

Should only be possible if the AI is able to see your sub, though.

I think it shouldn't happen even if he can see the carrying unit. Just way too unrealistic!

Dang! He had this great hiding spot in the engine room, I though it was totally safe!
But seriously, I don't think coastal guard had anything to do with it. See, I was at war with that civ, so it doesn't seem likely that my sub's captain would have given much attention to the demands of their coastal guard.

Another unlogical possibility:

Spies are very good to foment civil unrest for one turn (which lowers the defensive bonus of cities).
Therefore, during a war, it would be a very wise choice to bring a spy in your stack for the siege.
However, I don't think it is possible to actually "escort" a spy, while at war with another civ.
Reading the OP's stories, I think the spy has just as much chances of getting caught, whether it is inside one of your stack or not...

At least, the chances should be greatly lowered. Counterespionage during war-time would then become more useful.

That's true.
And while on water tiles, chances of him getting caught should be zero.

However, when you are at war with a civ, I think your espionage costs against that civ should increase, because that's what would normally happen IRL.

Anyway, are the mods gonna "confirm" this, or what? It is very easy to reproduce - just load a spy in a sub (or other transport), and move it in water tiles of some other civ, and wait for him to be "stumbled upon". This clearly should not be happening, so it is most definitely a bug.

I'm pretty sure it does, indirectly. Having trade access to a city gives you an espionage discount, and while you're at war there's no trade, so you don't receive the discount, essentially making it more expensive.
