Maybe IF we ask for some money

Maybe if we open a case in a local court asking for a couple of million they gonna start to pay some attencion to US...... I m really mad for pay $50 for a game who don't work.:king:
 
They are paying attention. And you have no legal standing to attempt a civil suit.
 
I know I can't win, but maybe the midia pay attencion to the problem, how can the release a product before test and free of problem...I understant they can't create 100% defect free, but they don't have anyone to speak about the problems and say they are working to solve the Civ4 fans problems, they have my money and I just ask for a product that work...Imagine you buy a car and break on the first corner and they even say The car have a problem we gonna try to fix, they just close the door and you see that they don't care, do you think they gonna return my money? I go back to Circuit city to try to return if I dont find a way to play, but I'm sure the store policy just let me exchange for the same item in this case!!!! I'm tired, I wanna bad publicit for this game , is not right they sell something without warning about problems!!!!!!!!!!
 
By clicking "ok" on the EULA (End-User License Agreement) when you install the game you loose any right to sue them.

IN NO EVENT WILL LICENSOR BE LIABLE FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM POSSESSION, USE OR MALFUNCTION OF THE SOFTWARE, INCLUDING DAMAGES TO PROPERTY, LOSS OF GOODWILL, COMPUTER FAILURE OR MALFUNCTION AND, TO THE EXTENT PERMITTED BY LAW, DAMAGES FOR PERSONAL INJURIES, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LICENSOR’S LIABILITY SHALL NOT EXCEED THE ACTUAL PRICE PAID FOR USE OF THE SOFTWARE.

So go for it if you want but even if you win the most you would get is the price you paid for the game. (Try hiring a lawyer for more than a couple minutes for that)

That's all people want, and if they have to go to court to get it, they should on principal.

That only applies to damage to your machine or other programs caused by the game. Since you pay for it before you agree to the EULA you could sue them for your $50. Would you win or would it be worth it to try, probably not.

Whats my position? Simple. It is a great game that unfortunatly has some bugs. I don't blame anybody. Its not Fraxis fault, its not Take 2's fault. It is a peice of software with millions, if not billions, of lines of code. Im pretty sure Fraxis and Take2 are not happy about the situation. No one sets out to put defective product out on the market. Things happen. Could a longer run of beta testing uncovered all the potential problems? Possibly, but how long would they have needed? Weeks? Months? Years? Say they took another 6 months to test it and uncovered the problems. So now it will take them another month or two to fix the problems. They fix them and those fixes are now beta tested again for another 6 -9 months and lo and behold they uncover more problems, so the cycle repeats. And Civ IV is never released. Id rather they release it like they did 85%- 90% confident with the end product and then work after the fact to fix it if problems arise. No peice of software will ever be 100% stable or 100% ready across the board. Its mathmatically impossible. Software engineers do the best they can, and I give them credit for the attempt. I could never concieve or produce a game any where near the quality of Civ IV even with all its bugs. Does the game have problems? Sure. But so did Yars Revenge on the Artari 2600 when it came out 20+ years ago. How many product recalls are made daily for everything from automobiles to baby strollers to bottles of cold medicines. Things happen, unforseen, unavoidable and unfortunate things, and not just with software. I'd be mad if Fraxis/Take 2 wasn't working to fix the problem, just like i'd be mad if Ford didn't work to fix problems with my Focus. But they are acknowledging the problems and working to correct them. And as a consumer thats all I ask. Do i feel i got my moneys worth out of Civ iV in the state it was shipped? Sure do. Because i know its not perfect, but its gonna be fixed, and I have taken steps to jury rig it myself until the official fix is released. I haven't gotten hopping mad and began calling for the heads of the programmers and blamed them for releasing a faulty product, because that would gain me nothing. It won't correct my problems any faster. It won't allow me to enjoy the game any better. All it will do is get me angry and frustrated over something that may have been out of the producers and programmers hands. I don't blame anyone for this. Sure its a foul up, sure it sucks, but I can't blame anyone for it. I just wait patiently.
 
Maybe you was able to play a minute or a hour before problem but I couldn't even 1 secund ok? I'm mad, yes I'm..... I dont blame for have problems, but i blame because nobody give me a information if they are working and why the problem.....try call assistence.....the have a list of question if nothing work they just say they cant help.....I gonna call again to try have more info about the problem, wish me good luck to find a info!!!!!!
 
I had problems playing too. I had constant crashes and lock ups and assorted other problems, but i didn't come to this forum to bash the company. I came for help from fellow players. I called the 1-800 number and they did their best to help me, but since they cannot sit at my PC and recode and configure the game specific to my machine, or write a patch addressing my specific issues they did the best they could. They also suggested coming here, which I did. I described my issues on the forums, asked for assistance, and got some good advice. All these people complaining and laying blame aren't going to solve the problems. Yes, almost everyone is aware their are known issues with Civ IV. Yes, Fraxis/ Take 2 are working on fixing the issues. But you have this resource right here avalible to assist you until Fraxis finishes their next patch.
 
Normally, I will not purchase a game until a few patches have been released. Normally, I don't buy games so soon after initial release.

Why?

Because most games are released like this and I don't see the point in giving my money to support decisions like this by the suits. I give my money after they get the thing working. You know, vote with your dollar and all that.

I made an exception with this game because, well, I'm an addict and can't help myself. Unlike others, I got lucky and the game works fairly well for me.
 
WarhawkC : I totally disagree with what you are saying. For you it is ok to pay for something that is not ready ? Even for cars. If I pay a good amount of my hard earned money for a car and it does not work correctly from the start I will be mad as hell. People accepting faults when a product is released make companies work like this. This is annoying and not acceptable. If I pay full price and the product needs to be fixed it is WRONG. If a software like Civ 4 does not work on some PCs that is somehow acceptable as there are millions of different setups, but this game does have confirmed bugs that prevents it to run on a whole lot of machines. I personally do not know anybody who can run it without problems and I am sure that the devs and publishers knew about these problems and I definitely blame them. They are responsible for this. Sure I am the idiot who bought it, but they can be sure that I will never ever pay full price for any of their products again.
Furthermore a fan, Harkonnen (great work btw :goodjob: ) was able to release a memory fix much faster than the developers. What a shame for Firaxis.
 
And Harkonnens "memory fix" didn't work on my machine. It made other problems worse. But thats besides the point. I'm pretty sure the developers didn't just "push this game out the door" with bugs any more they Ford pushed the Focus "out the door" with faulty wiring. Regardless of how much you test something you are never going to catch every problem. Civ IV works like crap on my computer, but my wife's PC It runs beautiful on. Not a single glitch. The problems are not as wide spread as some people on these forums want you to believe. I went to Gamestop the other day and there were a lot people buying Civ IV and no one returning it. I mentioned to the sales guy the problems i was having and he said his LAN group had just played a tourney of Civ IV that weekend with no problems. Huge Map, 20 players. So tell em again how bad these problemsa are based on the vocal few on an internet chat forum.
 
I really easy don't be mad when do you have another computer at home to play!!! I tried intall in my sister computer but i dont have time to go every day after midnight to my parents house...If you try to return 99.99% of the place won't take back, if the problem was only in my computer, but there is a lot of other people with similar problem ok? I have played DOOM3 in ultra resolution with any problem and i don't really think Civ 4 need more machine ok? My sister $500 computer works better than my $2000....so there is some thing wrongh....... I just don't understand why all this people in tecnical support if is normal!! if is the machine problem how anyone found the problem?I m sure there is a conflict in the 3d control and file...I home that for all Civ4 nations they found the cure!!!This is a Advance Tech in the Game Cure for All Civ4 Bugs!!!! HAHAHAHA
