So in my new game I am doing a True starting locations with all the civs, gigantic map. Its been fun, I am china. I am way ahead and eventually around 6 civs declare on me at once ( it seems like the AI band together eh?). My military advisor says I can wipe Japan or Mongolia off the face off the earth and I took Mongolia's capital. Yet when I go and talk to them...

The AI (and the player in fact) is prevented from making peace with a nation it attacked because another nation asked it to (or it asked another nation to). You get the "come to be for mercy?!?" message in this circumstance as well as if the AI thinks it can win. If the AI suddenly gets desperate for peace in a few turns, this is probably what happened.
 
There's a lock-in period for war to prevent oscillating wars from being started and stopped. This seems more like a script issue because it only has a few arrogant lines to say when it doesn't want peace/can't give you peace.

Civ3 had the same issue.

I actually appreciate the fact they scripted in 'end is near' as a scripted response when you're dealing with a defeated AI and are marching to their capital.
