Dumb question but - why can't I declare war?

I've been playing a long long time but I don't think I've had this problem before. Playing BTS.

I've decided to war early, to take advantage of a weak Xerxes. Having grabbed some troops and rushed over to his two vulnerable cities, he won't talk to me!!

If he won't talk to me, how do I declare war?

Is there something elementary I've forgotten here?

I mean fair enough I'm -6 in the opinion polls but what do I do.

ctrl rightclick as far as i remember ...

sure you haven't bullied him into something within the last 10 turns (including making peace)

Of course! Jiao asked me to stop trading with Xerxis, so to curry a bit of favour, and as I was thinking of waring, I agreed.

Should have refused then I'd still have him talking to me.

If you don't have open borders, you can just walk your troops into his territory or you can Alt+Left click on his name.
