and another completely different proposal:
the 3 JUDGES have all say for guilty/unguilty.
all 3 must come to a conclusive ruling on it (no majority thing) within one week, otherwise one of the moderator decides the ruling.
if ruled guilty, the judges decide which "range of punishment" is fitting and post a poll for them.

sidenote to #41: of course the judges would need to neither be and officials (including governors or deputies) nor moderators.

No, I'd prefer a jury system where all or almost all citizens got to vote to decide punishment.
