porn question

I realized something today while watching a *movie*. How can porn be legal, you are paying to prople to have sex. Is there some legal loop hole?

In the US, until 1987, porn could be technically illegal for this reason. A Supreme Court decision in 1987 ruled that sex on camera is a legitimate form of expression and art.

Then you should let my local judges know about this.

From 2001:

Whistleman admitted paying people to perform sexually on camera for a start-up Internet business. The law simply bans trading in sexual activity for "anything of value" and does not specify participation in the sex act.

Devanie acknowledged at sentencing that his client had violated that statute but said Whistleman did not realize paying actors to make pornography is illegal, because the porn industry is widespread. He argued the law is meant to ban street prostitution, but Horne said that his office would consistently enforce prostitution laws within the county.

This guy didn't have a 'professional photographer's license' which may be required if you are making the porn for a profit.

Isn't there an awful lot of amateur internet porn? How is that covered?

Have you ever read the fine print, or those tiny words at the beginning of those movies? Who reads those, anyways? ;)

They usually state something like they verified the ages of the actors, blah, blah and it *might* say something about a license (I'm not sure) or that they followed certain laws....I never looked at it that closely :D

The people aren't paid?

Usually it is someone who is trying to make a name for themselves, so possibly, but I would still think that they would receive some money.

Seriously, don't a lot of them require subscriptions though (I imagine)?

If you want the full movies, yes. Small clips can be found for free all over the place. They often put the 'fine print/legal stuff' in the small clips, too.

Question. Would that mean that you have to be a legitimate 'pornographer' to film such movies? So some guy can't just do it in his living room? Last I thought boxing in a ring in your backyard was also illegal.

you have to have a permit for it...then yes... All cie also have a permit (inc.) for their respective business...

But the full movies mean that the actors are getting paid at any rate, and probably don't have a license, how does that work?

I didn't think the actors needed a license, only the photographer (and the ones who are distributing the film if this is not the photographer).

Here is an example of the legal print:
