If someone is on the ground and you and your buddies are kicking the crap out of him or her then it can be considered attempted murder and rightfully so. Lots of people have met their maker this way. People just don't realize how easy it is to kill someone like this.

Did they attempt to murder him. The charge of attempted murder is one that is based on the intent of the attack. Charges of murder would be given if the person died even if the intent to murder wasnt there. But since he didnt die, and the intent wasnt murder, I dont see how one can say it was attempted murder because they COULD have killed him inadvertently.

Well, I think it is:

Manslaughter if the victim dies but you didn't mean to kill them.
Attempted murder if you meant to kill the victim but didn't.

Thus obviously there can be no such thing as "attempted manslaughter", ie if you didn't intend to kill the victim and the victim didn't die it doesn't matter if it were possible, you can't charge them for either.
