Well Civ1 isn't public domain; it takes like 25 yrs IIRC for something to be Public Domain under US law (which governs Civ1) and I believe the Borne Convention is likewise.

unless fraxis releases the source code, and all rights to the game, to public domain, i wonder if we right them, maybe they could relased the source code and game rights to public domain?
 
The source code doesn't exist anymore.
 
Farxis didn't grab the source off Atari when they bought them out. True, the source could be somewhere a hard drive but I would be suprised if it turned up on the net. Plus, if Farsxis *does* have it, they aren't going to release it.
 
Games are only LEGAL abandon-ware when the company announces it is public domain. IF the publishers can no longer support that game and you download it, it's ILLEGAL abandon-ware. Anyways, as stated before, Firaxis owns the rights to Civ, to Civ 1 is still technically theirs.

Or the company becomes defunct without transferring assets, which does happen. In this case, in the US at least, it's still not "legal" in the sense of being public domain, it's that enforcement becomes impossible with the lack of a plaintiff so there is effectively no difference. None of this applies to Microprose properties, of course, because, as you mentioned, assets were transferred to Firaxis.
 
No, Civ1 is still not freeware. Yet there are many places that actually offer it for free as abandonware, and get away with it. I guess no-one seems to think the Civ1 sales will influence their accounts anymore, so they don't chase those sites (they're wrong, if I hadn't bought the game years ago I would still pay quite a lot for it, and the same goes for most of my friends...).
 
I just recently obtained a copy on 3.5" disks, still sealed in the original box, from ebay for $1.00 + actual shipping (cost me $6.00 total). It installed on my legacy DOS box with on problems. I'm surprised that the disks were not corrupt from just sitting around.

So it is still possible to find a copy out there.
 
I really appreciate that somebody still plays the game I have enjoyed about 20 years ago. Enjoy it!
