You can probably use the colours as long as you are not using them in a way that might be confused with a mod version. So you wouldn't be able to write "Stop posting!" in red as it might be confused with a mod warning...

Now how in the world do you do that? I know who the moderators are so as do most posters so it wouldn't be that hard to figure out if that person is about to be banned or ban.

If they forgot the tag the text would not be red.

They might have been editing their post and accidentally altered the tag to just a colour tag rather than a moderator tag... Either way its possible that someone using red and acting like a moderator might just be a moderator as they might be a new mini mod or something...
