Public Investigation - Neutral Leader

In accordance with the Code of Standards, Section H, this Public Investigation is opened. The Chief Justice will manage this investigation until such time that a Judge Advocate Pro Tem is confirmed.

Cyc and Shaitan, citizens of Fanatika, have made a public request for investigation of Neutral Leader, Governor of Bohemia, for violation of several areas of Fanatikan Law, specifically:

Constitution, Article J:

Elected officials must plan and act according to the will of the people.

Specific violation would be posting of cultural and domestic based build queues against the specifically polled and discussed wishes of the citizens for a major war buildup.

Code of Laws, Article D, Point 1:

c) A governor organizes the production (building queues) of the cities in a province.
d) A governor organizes the tile use in his province.

The accusation is that Neutral Leader has not performed his duties in office, which would include those areas noted above, and the associated responsibilities such as posting build queues, responding to discussion and requests in his government thread, and other abandonment of duty actions.

A Public Investigation is conducted in accordance with the Code of Standards, Section H. This post will be used to update our progress in the investigation.

Point 1 - The allegation was posted in the Judical thread

Point 2 - The allegation was made in proper format.

Point 3 - I have sent PM's to Neutral Leader, and the Public Defender notifying them of charged filed.

Point 4 - This post satisfies Point 4.

Point 5 - The reserved time period has passed, the thread is open for discussion.

Point 6 - Discussion will ensue for 48 hours.

The 24 Hour period has passed without NL requesting defense, or posting his own defense. This thread is now open to discussion of the charges.

Additionally, the Judiciary has been asked to add another violation to the list of charges, note that above.

Please post opinions here as to the accuracy of the charges, recommended punishment or dismissal, etc...

Please also keep the discussion professional and very much on topic.

The prosecution feels that Impeachment is warrented in this case.

Wow, I didn't see this thread. Guess I've been checking the tourny saves too much. Ok, I say impeachment too. He had promise when he was a citizen, but dropped off the face of the planet by the time he became governor.

Just to recap the series of events: Roughly 18 hours after the thread was started I learned of the PI and notified neutral leader by PM of his rights and options. 8 hours later I had not heard anything, and notified the Chief Justice of this fact.

I still have no response from the accused. However, even though I am not officially defending neutral leader it is my responsibility to see that he gets a fair trial. To that extent my role in this proceeding will be to verify evidence, to make sure our established procedures are followed, and to raise legal arguments based on interpretation of law that might affect the outcome of the trial.

Okay, that being said:

In this 'discussion' thread I have seen no presentation of argument or evidence. The posts have, with the exception of the Chief Justice's official procedural posts, been entirely devoted to what should happen to neutral leader, not an examination of his alleged activities leading to the PI.

Our laws specifically state that all accused are presumed innocent. Statements such as 'we all know what he did, impeach him' do not reflect this basic tenet.

The fact that neutral leader is not present should make us *more* careful in how we undertake this PI, not less so. We need to act impartially and professionally in order to maintain the high standards we have set ourselves in our laws, and in which we hope to undertake the actions of our nation.

Please present evidence or argument. People are jumping to sentencing and at this point, neutral leader is, BY LAW, innocent.

The laws on an investigation do not mandate a 48 hour discussion, they say that discussion will run until it peters out and at least 48 hours have passed. There has been no evidence presented and no argument by prosecution or defense. There has only been a rush to judgement. I ask that, at a minimum, the Judge Advocate present evidence that the charges are not baseless.
