Proof the AI will go through your borders to found a city. Mao here went through mine, Wang's and Sury's territories to found this little gem.
Where the Hell did you come from? I haven't even discovered the New World yet. Ugh you must have a tech lead on me. You'll be a pain to kill later then.

Ok, so the thing with the last picture is that the Phalanx is supposed to replace the Axeman and not the Spearman that it says?

Bingo. And I lowered its strength by 1 and gave it the bonus of that of Spearmen while keeping the bonuses it had when it replaced the Axe.
which makes it completely useless ... basic Spearman allready wins easily over Chariot, and giving it a higher win chance against attacking Chariots is just unessecary overkill, while they still loose towards axemen
... AI's have no problems sailing to another island/continent to settle, even if its through one/more enemy civs ... its only if its through land they rarely want to do it

And how is it possible for him to have that pikeman there? Did he got a warrior from a hut and then upgrade it? Why would he do so?

There never was any hut there. The Civ IV AIs teleport around their units within their borders. It's a clever way of making the game more challenging, but in such a way that it's nearly hidden to players.
