Ok this is a story from the UK, here is the full text from the telegraph with the interesting parts bolded.

David Armstrong, a supply teacher, escaped jail with a suspended sentence after admitting possessing 4,500 indecent images of children.

As she allowed the 63-year-old to walk free from court, Judge Mary Jane Mowat told him: “I don't criticise you for being a teacher who's attracted to children.

“Many teachers are but they keep their urges under control both when it comes to children and when it comes to images of children."


Child abuse campaigners yesterday described the comments as “outrageous” and an insult to victims.

Teachers also attacked the remarks, saying they cast a shadow over their profession and sent the wrong message to child sex offenders.

Peter Bradley, deputy director of the children’s charity Kidscape, said: “Children who have been sexually abused would be horrified to read this judges remarks.

“Schools are not places where those attracted to children can work – schools are there to provide learning in a safe environment where children know the people who look after them can be trusted and relied upon.

“This teacher should not have been in the profession and it is outrageous for the judge to say many teachers are sexually attracted to children.

“The message needs to be clear – if you are sexually attracted to children then you don't work with them.”

Christine Blower, General Secretary of the National Union of Teachers, said: “Teachers are professionals whose interest is ensuring children and young people achieve their educational potential.

“To suggest their interest in pupils could understandably be anything else is totally unacceptable.”

Jayne Phillips, Senior Legal Advocate at the Association of Teachers and Lecturers, added: “It is a very worrying message to send out.

“The judge’s comments do not reflect our knowledge of the UK’s teaching staff – they would be appalled by the suggestion that they are in anyway attracted to children.”

Married Armstrong was caught after a colleague at the Little Heath School in Tilehurst, near Reading, Berks, reported him to police.

Reading Crown Court was told that the teaching assistant became alarmed after noticing files on Armstrong’s laptop with names including “rape wife”, “nude model” and “gay alligator”,

Police arrested Armstrong and found 4,500 indecent images and videos on two laptops and an external hard drive. More than 300 of the images were in the two most serious categories, some involving children as young as two.

He admitted five charges of making indecent photographs or pseudo-photographs of children between 2007 and 2010. The court heard that some of the images were not of real children but Japanese cartoons depicting youngsters in sexual scenes.

Judge Mowat handed Armstrong a 12-month prison sentence, suspended for two years.

She added: “This was by any standards a substantial collection, with some 300 of the worst kind.”

Armstrong, of Devizes, Wilts, was placed on the Sex Offenders’ Register for ten years and served with a sexual prevention order banning him from owning a computer or device capable of connecting to the internet.

He was also ordered to undergo treatment for his attraction to children and is automatically banned from working with youngsters.

Robin Shellard, defending, said his client had worked at many schools and colleges during his career and had an impeccable record.

The case is not the first time Judge Mowat has stirred controversy over sentences handed to sexual offenders.

In 2008, she allowed former headmaster Phillip Carmichael to walk free from court after accepting that medication for Parkinson’s disease had turned him into a paedophile.

Sentencing a bus driver to ten-months in jail in 2006 for abusing a 12-year-old girl, the judge acknowledged that she felt “obliged” to lock him up because of “current views about sentences”.


“I have a record of trying to suspend sentences in cases like this and them ending up in the Court of Appeal,” she told Robert Prout, following a public outcry over the brevity of prison sentences for sex offenders.

tl;dr - supply teacher who had an attraction to children and who owned a catalogue of pornagraphic material depicting children (cartoons) - is "left off" by the judge with a suspended sentance and commenting she understands his "urges" to children.

Turns out this wasn't the only case as she rued having to lock up a guy who abused a 12 year old guy, and letting another guy walk free because of the medication he was taking.

So...why hasn't this Judge been sacked yet? Is the sentances she dishes out appropriate for the crime? Am I being hideously reactionary or is there definitley something wrong with this? Your thoughts?
 
The judge should be sacked and probably jailed. She is likely mentally ill and possibly a paedophile herself.
 
Sounds about right in the "progression" of things. It is unfortunate though, but I don't see things getting better.

Really? I see every other sex-offence case in the UK being handled better than this.
 
It depends and detail is needed. Idk about uk but in us iirc, cartoon image of children arent illegal. It said some of his collection were so if rest were inappropriate pic of real children he shouldnt have been freed. (Edit: actually nvm it does say he had over 300 seriously inapptopriate contents missed that on my girst time)

medication ruling was just stupid. But any crappy judge thats scientifically illiterate could have done the same. Her stance on the issue is clear tho so it was probably no accident that it helped her bias.

I don't think there can be a treatment for this. If he is going to be medicated or something, then it isn't going to work. I think they did something like that to homosexuals in the past. Alan Turing anyone?

How to parse this: It seems hell has little to do with this. I asked a question. I would not say your morality is in question. I have this weird feeling that equality has not been fully realized. Now I fear the day that it is, because like I keep trying to say, When every one has rights, no one has rights. And that is not a pun. There are reasons for laws, and when you start making exceptions to create a false equality some may soon realize that all they have achieved is no laws at all.
 
What is a supply teacher? A substitute teacher?

Perhaps the medication isn't used to cure an attraction but to give better impulse control.

Yes. You are on a list of teachers to be called in when the regular teacher is off sick. Often, because the regular teacher is off long term with stress and such issues. Because they have to deal with children with serious problems, children whose parents don't care where they are as long as they are out of the way, parents who come into the school and attack teachers, etc. My mum used to do this and I was very glad when she retired.

No one is disputing what sexual molestation is, and nobody is trying to legalize it. How I see it, the judge here isn't trying to let sex-offenders off as much as trying to follow a more nuanced view of pedophilia, where the 'urges' are treated differently, and perhaps more sympathetically, from the 'acts' themselves.
That said, I do think that collecting sexual imagery of children counts more as an 'act' than an 'urge', and that this sentence should not have suspended. But I get her attitude and think there's probably quite a significant bit of what she said that we're missing.

I understand what you are going about here. But in a American court, this guy would get time. All the prosecutor has to do is use that against him in front of a very passionate jury.
 
The American legal system is hardly something that any country should strive to emulate.
I am not advocating that it is the best one.

Curious. What do you think is the best legal system?
 
I know in Arizona possession of child porn is treated as the same as if someone actually molested a child which can lead to someone getting a massive sentence. In other states it's different and I wouldn't be surprised to hear of certain judges with unusual opinions giving someone a light sentence.
