"Now, the trial of Saddam Hussein is truly a difficult resolution. Where? When? These are just some of the questions presented before us. Now, I support Germany's motion, which you shall see later. But, I must urge Germany to instead of hearing Saddam's trial in the international court in Hague, (sp?) we should allow him to choose between American court, International court, and Iraqi court. All people are allowed the court they feel will earn them a just sentence, and Saddam Hussein, though the vicious genocidal mass-murderer he is, should receive nothing less than these basic rights."

The Chilean Representative's Official Introductory Statement

It is the opinion of the people of Chile and myself that Saddam Hussein must be tried for war crimes. This is obvious. However, we cannot ruin the sanctity of the recently established International Criminal Court or of this organization, the United Nations.

Because the United States bypassed peaceful and logical methods of confronting the Iraq problem, the United Nations was seen by some as antiquated or useless. This is not so. The only times the United Nations is usless is if its' member nations stop cooperating, which must not happen. Therefore Saddam Hussein must be tried by the United Nations and the International Criminal Court.

The most reasonable set-up for this trial would be a board of 7 or 9 jurors, with some being from the International Criminal Court and some being Iraqis. This court would try Saddam Hussein for the crimes he committed as leader of Iraq. And, because it is the opinion of this ambassador and of the nation of Chile that the death penalty is suitable for extradinary or heinous crimes, the death penalty would be an option at the trial of Saddam Hussein.

As many of you know Germany has drafted a resolution for the trial of Saddam. It is the belief of Germany that Saddam will only recieve a fair trial on an inter-national forum. We know that the United States respectes one's right to a fair trial and we trust that the United States will recognice that an inter-national trial is the only fair trial for Saddam. We ask for the United States' cooperation in turning Saddam and his trial over to the inter-national community. We also ask for the United States cooperation in the gathering of evidence for the prosecution. The Resolution we have drafted honors the ideals of a fair trial and basic human rights. We have faith that each of you will see that this resolution guarantees a fair trial while ensuring justice is served.

We propose that the trial of Saddam Hussein should be conducted in an Inter-national War Crimes Tribunal to be held in Hague Netherlands. We propose that there be three permenant judges that will preside over the hearings. These judges will be apointed by the Security Council. Each Judge will serve a term of 4 years after which they will have the option for re-election by the security council.The judges hear testimony and legal arguments, decide on the innocence or the guilt of the accused and pass sentence.

We propose that The Office of the Prosecutor (OTP) operates independently of the Security Council, of any State or international organization. Its members are experienced police officers, crime experts, analysts, lawyers and trial attorneys.
The OTP conducts investigations (by collecting evidence, identifying witnesses, exhuming mass graves), prepares indictments and presents prosecutions before the judges of the Tribunal.

We propose that trial only takes place when the defendant is present. That the trial follow recognized principles of a fair trial including: presumption of innocence until proven otherwise, the right to be tried without undue delay, the right to examine adverse witnesses and the right of appeal.

We propose that the maximum sentence that may be imposed is life imprisonment.

We rely on states' cooperation for the collection of evidence as well as to the detention and transfer of accused persons. States also offer indispensable cooperation in the relocation of sensitive witnesses or the enforcement of sentences handed down by the Tribunal.

The Representative of Chile would just like to interject quickly and point out that he supports the resolution proposed by Germany, although his official support is unnecessary at this point.

He would like that the death penalty be an option for Saddam Hussein, but a compromise may be necessary to win over support of the abolitionist states...

As the representative from Deutchland has stated, we support trying Saddam Hussein al-Tikriti at an International Tribunal in the Hague, Netherlands. As much of our position has already been covered, I will give the floor to the esteemed delegate from the United States.
 
well, first off the United States first and foremost see that it, and its allies opinions on this matter by far out weigh the opinions of the international community at large, considering it was we who actually flexed the proverbial muscle in capturing Saddam Hussein.

therefore, the United States, has its own ideas on what should happen-

A)the trial itself shoul dindeed happen in a relivelly nuetral nation

B)the trial itself should be headed by The United States, Iraq, and a third member, voted on by the general assemblly

C)the trial itself should have the death penalty open unto it, though be based on the standards of international law (failly sure that it (the death penalty) is open in international law, and I owe that fact of thinking that to Nicator :goodjob: )

D)the assemobly of jurors should be of an equal mix of nations who both supported the wr effort, and those who did not

E)the juror nations should be picked on no criteria, and so the US suggest we choose lots randomlly (in other words, just cut up a peice of papre, write evey one name on them, divide them into who supprted the war, and who didnt, put the piles into spererate hats, and draw an egual number of names from them ;))
 
can you cancel support for another resolution, if so is wholeheartedly support Xens, its basically a better refined version of Andrewgprv's res.

Yes, you may.

However you should be aware that Xen's proposal has a much larger position for the US and the Coalition in the trial, while andrewgprv's proposal is a totally independent council.

BTW I will support Germany's proposal if it is necessary.

Ambassador Ronaldo Mota Sardenberg of the nation of Brazil steps up to the podium.

Mr. President:

As you, as well as the rest of the world, know, our nation chose not to support the U.S. led war against Iraq.

We therefore feel that it would be in the best interest of the world if such a trial was held in Iraq, in a court created by the people of the Iraqi nation. The crimes of Saddam Hussein were against the people of Iraq, not the other nations of the world. In addition, he should have the right to a trial with a jury of his peers, one of the many fundamental rights of all human beings. Saddam Hussein is still a human being, and as such is entitled to these rights.

We agree with the Honorable Mr. Negroponte of the United States in the matter of the death penalty. Brazil is a nation that reserves the death penalty only for the most extreme of crimes. The crimes of which Saddam Hussein is charged are certainly extereme enough to warrant the ultimate price.
