Sort of.... it would need to be interpereted by the Supreme court eventually, if they had the money to do so. They probably should, and will, contact the ACLU.
 
There is a lot of the attitude 'its a small town; who cares' and 'they won't enforce it so who cares'. If it can happen in one place, it can happen anywhere. And this case is being enforced, isn't it? I'm not sure where people are getting their evidence from, but its being enforced now indicates to me that those people just might be wrong.
