Can't Declare War - Sneaky AI Mind-Trick

I was trying to pick a fight with Cyrus, who had arrogantly planted a city on my continent. When Kublai Khan asked me to cancel my dealings with the vile Persians, I was only to willing to comply. I figured if that didn't cause Cyrus to declare on me, I would just declare on him the next turn.
But guess what? He got so mad at me for cancelling the deals with him, that he wouldn't talk to me. He won't talk, I can't declare. And, since our Open Borders agreement was still in effect, I could just march into his city and out again, but couldn't attack it! I tried to cancel the OB, but I couldn't. I had to wait ten turns to even be able to cancel the OB, then and only then could I march in and force a declaration. Of course, by then he had double-fortified his city units. Aaargh! Sneaky AI!
Anybody else have this happen? Any way around it?
 
Alt-click? Is that different than just a click? Because when I click, his leader head pops-up and he just says "Go away, I'm not talking to you"
 
Yeah - alt click declares war...

You can also just declare war by entering onto his territory, or a unit...
 
^^^^^I think that first part's right, but not the second. Unless you're at war (which, again, can be achieved by alt clicking on him in the leader list on main screen on the right) trying to enter his territory will result in a red circle when you try to click, and moving onto his unit outside the territory will just stack them.

No - if you don't have open borders, it will ask you if you want to declare war - same with moving your unit on top of theirs.

This is only true when you have an active Peace Treaty which cannot be canceled (first 10 turns, DP, PA, vassal, etc.)

Check the domestic adviser for active treaties to see if this is the case.
