Well considering that the administration has repeatedly said that they aren't POWs and therefore aren't military men, I would have to say civilian unless the government would like to take back its previous statements.

But that still leaves the question of who has jurisdiction.

For detainees not originally captured by U.S. forces, should we just turn them over to whomever we got them from?
