Did Jesus exist? Court to decide

Wednesday, January 4, 2006; Posted: 1:35 p.m. EST (18:35 GMT)

ROME, Italy (Reuters) -- Forget the U.S. debate over intelligent design versus evolution.

An Italian court is tackling Jesus -- and whether the Roman Catholic Church may be breaking the law by teaching that he existed 2,000 years ago.

The case pits against each other two men in their 70s, who are from the same central Italian town and even went to the same seminary school in their teenage years.

The defendant, Enrico Righi, went on to become a priest writing for the parish newspaper. The plaintiff, Luigi Cascioli, became a vocal atheist who, after years of legal wrangling, is set to get his day in court later this month.

"I started this lawsuit because I wanted to deal the final blow against the Church, the bearer of obscurantism and regression," Cascioli told Reuters.

Cascioli says Righi, and by extension the whole Church, broke two Italian laws. The first is "Abuso di Credulita Popolare" (Abuse of Popular Belief) meant to protect people against being swindled or conned. The second crime, he says, is "Sostituzione di Persona," or impersonation.

"The Church constructed Christ upon the personality of John of Gamala," Cascioli claimed, referring to the 1st century Jew who fought against the Roman army.

A court in Viterbo will hear from Righi, who has yet to be indicted, at a January 27 preliminary hearing meant to determine whether the case has enough merit to go forward.

"In my book, 'The Fable of Christ,' I present proof Jesus did not exist as a historic figure. He must now refute this by showing proof of Christ's existence," Cascioli said.

Speaking to Reuters, Righi, 76, sounded frustrated by the case and baffled as to why Cascioli -- who, like him, came from the town of Bagnoregio -- singled him out in his crusade against the Church.

"We're both from Bagnoregio, both of us. We were in seminary together. Then he took a different path and we didn't see each other anymore," Righi said.

"Since I'm a priest, and I write in the parish newspaper, he is now suing me because I 'trick' the people."

Righi claims there is plenty of evidence to support the existence of Jesus, including historical texts.

He also claims that justice is on his side. The judge presiding over the hearing has tried, repeatedly, to dismiss the case -- prompting appeals from Cascioli.

"Cascioli says he didn't exist. And I said that he did," he said. "The judge will decide if Christ exists or not."

Even Cascioli admits that the odds are against him, especially in Roman Catholic Italy.

"It would take a miracle to win," he joked.

Another sign that some people will not settle until religion has been vanquished from this Earth.

This is too far considering that there are many historical sources that Jesus did in fact exist. this should be dismissed right now

Nonsense,i dont see any bias in this viewpoint, history has shown that institutions[ie.The Catholic church for example]have propagated golden lies in order to subjugate the masses in their control by creating myths.

"In my book, 'The Fable of Christ,' I present proof Jesus did not exist as a historic figure. He must now refute this by showing proof of Christ's existence," Cascioli said.
Well, not really. All Righi has to do is show Cascioli's "proof" is not really proof.

This one is right up there with the injunction against David Letterman from last week.

Why is a court deciding this? And they should be going after every single religion if they're going ahead with such foolishness.

good, the sooner the world gets rid of the shackels of religion the better

It'd be better if people actually did convincing that religion shouldn't be around rather than have it done by lame judicial fiat.

Quite sad to see this happening. I guess a few fundamentalist Athiests are going at nothing to eradicate religion from the planet :(. Absolute foolishness in my opinion.

What would take its place then? To say science would be naive considering the large number of stupid and ignorant people. That leaves worship of the state which I'm not so certain is better (probably worse). There will always be people who need to worship something, it's a part of human nature.

Italy is a member of the European Union. Now, I am sure that Italy has freedom of religion laws of its own, but I know that the EU does. There is simply no way under the EU Bill of Rights that the teaching of Jesus as the messiah, son of G-d, member of the Trinity, and G-d could be baned. Besides, there is more historical evidence in support of Jesus than against.

Actualy it was fundamentalist Christians prohibited an athiest for writing a book.
I aint no fundamentalist Christian. But I feel that athiests should leave all religion alone. Us non-fundamentalist Christians never even bothered with them.

Uh...what the hell is a fundalmentalist athiest? I mean, do they try harder to not believe in a god?:D

I was thinking more on the lines of activist atheist...

As for the topic, one nutjob hardly constitutes a "global war" on christ or anything else for that matter...

When did CurtSibling move to Italy?

:)

Using the Bible, and only the Bible, to prove that God doesn't exist! That's what a fundamental athiest is!
