DECREE OF THE PRESIDENT REPUBLIC OF INDONESIA
NUMBER 76 OF 2018
REGARDING
DUTIES OF SHIPS AND AIRCRAFT DURING
TRANSIT PASSAGE OF THE MALACCA STRAITS
BY THE GRACE OF GOD MAHASA ESA
THE PRESIDENT OF THE REPUBLIC OF INDONESIA,
Considering:
a. the transit of warships of the People's Liberation Navy through the Malacca Straits;
b. the continued campaign by the People's Republic of China against states bordering the Malacca Straits in violation of United Nations Convention on the Law of the Sea Article 39, Section 1, Subsection b;
c. the preamble and Article 1, Subsection 2 and Article 30, Subsection 3 of the Constitution of the Republic of Indonesia 1945; and
d. Presidential Decree No. 83 Year 2016 Certain Measures Relating to Parties Engaged in Territorial Disputes.
In view of:
1. Article 1, Subsection 2 and Article 30, Subsection 3 of the Constitution of the Republic of Indonesia 1945;
2. The United Nations Convention on the Law of the Sea Article 39, Section 1, Subsection b;
3. Law No. 14 of 2017 on National Sovereignty (State Gazette of the Republic of Indonesia Year 2014 Number 130, Supplement to Statute Indonesia Number 4321);
3. Law Number 36 of 2017 regarding National Defense (State Gazette of the Republic of Indonesia Year 2015 No. 120, Supplement to Statute Indonesia Number 5048);
4. Presidential Decree No. 83 Year 2018 Certain Measures Relating to Parties Engaged in Territorial Disputes; and
4. Government Regulation No. 43 of 2016 regarding the Declaration on the Conduct of Parties in the South China Sea (State The Republic of Indonesia Year 2016 Number 106, Additional State Gazette No. 4423).
DECIDES:
Stipulating: PRESIDENTAL DECREE REGARDING DUTIES OF SHIPS AND AIRCRAFT DURING TRANSIT PASSAGE OF THE MALACCA STRAITS
Article 1
To close passage of all People's Liberation Navy vessels transiting the Malacca Strait in defense of the principles enshrined in the Constitution of the Republic of Indonesia 1945 and The United Nations Convention on the Law of the Sea.
Article 2
To recall the Republic of Indonesia ambassador to the People's Republic of China in protest at the flagrant violation of The United Nations Convention on the Law of the Sea and the sovereignty of the Republic of Indonesia and her allies.
Article 3
To close all other contiguous bodies of water in the Republic of Indonesia to People's Liberation Navy vessels.
Article 4
To reiterate protests from the Republic of the Philippines and Socialist Republic of Vietnam concerning recent actions by the People's Liberation navy in relation to Da Dong, Chu Thap and Recto Bank.
Article 5
To note the support of the Government of Malaysia, the Republic of Singapore, the Kingdom of Thailand, the Republic of the Union of Myanmar and the Lao People's Democratic Republic in this matter.
