Well, there are certainly a large number of intelligent white-collar criminals. And "steal the office stationary" criminals are all across the spectrum.

But the main cohort of criminal that's in jail is strongly biased towards the unintelligent.

Rape? As horrible as it is, would you really want to lose your human rights over a case of alleged date-rape?

Kidnapping...seeing as the vast majority of cases are custody disputes, I don't know if i could get behind that...

Child Abuse? As unpopular as it might be, I don't think even that qualifies you as less-than-human, albeit a pretty dispicable human.

Give me the benefit of the doubt and assume I am halfway intelligent and that I don't want to kill someone for involuntary manslaughter and . .. .. .. . like that.

But that's my point. Who or what decides who gets stripped of human rights? The judge? Does the law have the specify about thier malicious intent? An evil-o-meter?

Obviously the law will decide. Manslaughter wouldn't be executable but first degree pre-meditated would be, so on and so forth.
