Once they surrender, they become a POW, and ar thus granted a whole myriad of rights they didn't have as enemy combatants. That's the loophole the US used with inmates at Gitmo. You are obliged to do many a thing for a POW, and denial of such things is tantamount to war crimes ( Hanoi Hilton, anyone?).
Ironically, even Nazi Germany, with all of it Concentration camps and other what not, followed this code of conduct. Their POWs were treated just as well as in any Allied nation (save for Russia of course).

I don't really see the soldiers as doing wrong. Yes threatening to kill a compadre if he squeals on them is wrong, but killing militants who are using humans shield, even if they pose no serious threat is not too wrong.

Of course the soldiers said that, they are facing years in prison, they try to avoid that the only way they think they can.

Point is that under current military law that is a war crime.....

In warfare only those who are actively resisting or can be reasonably assumed to still be hostile should be killed. Any other killings and it simply becomes counter productive as it makes the population hate you more

The keyword is current. Itys current because thats what the West has decreed. As the power of the West declines in the world, we'll see such things disappear.

To us, the idea of twelve year olds fighting is repugnant. But outside of the Western world, it is routine. This is fact.
