That's a tough one. I'd guess the counties with a Democrat majority among US states having a Republican majority during 2004 presidential elections. I know that sounds weird.

This could work to explain red coloured counties, but I have absolutely no clue for grey ones. Maybe overall counties having a decent democrat voters base (such as 40% minimum of voters).
 
Well, I'm hungry and impatient for more maps quiziness. So here are some historical world maps to play with. I've got two sets of seven to offer, but will start with just one set.

Can you date each of the following to within, say, 100 years of when they were made? Bonus coolness if you can say who made them (not all have named makers though) and from which culture they come, pondering on which should help with the dates.

The UK occupied Egypt in 1882 IIRC. As Egypt is not red in the map, I thought the map was before 1880.
But as we can't read the legend, it's not easy to say exactly what the red is.
Official colonies? Occupied territory?

I think the scramble started before the Berlin conference, which was more an attempt to regulate the scramble and avoid to much conflict.

nope... you are completly off... I ill give a hint as I want to switch to world... the darker red and grey represent city areas.
