An individual, including a citizen of the United States, determined to be an unprivileged enemy belligerent under section 3(c)(2) in a manner which satisfies Article 5 of the Geneva Convention Relative to the Treatment of Prisoners of War may be detained without criminal charges and without trial for the duration of hostilities

A individual who is suspected of being an unprivileged enemy belligerent shall not, during interrogation under this subsection, be provided the statement required by Miranda v. Arizona(384 U.S. 436 (1966)) or otherwise be informed of any rights that the individual may or may not have to counsel or to remain silent consistent with Miranda v. Arizona.

Just crazy stuff right there. Even if you can hold your nose to avoid the stench of unconstitutionality, think of it practically. An American is detained and is supected of being an unpriviliged enemy belligerant (ueb). He is not read his Miranda rights before interrogation to determine if he actually is an ueb. It turns out that he isn't, but merely a very dangerous criminal. Guess what? You have just statutorily botched the prosecution because any statements he made during the interrogation can be supressed.

McCain's being challenged by right wingnut extremist. So he needs to be more wingnuttish himself to head off the threat.

In all fairness, at least people detained under the Geneva Conventions would be documented and the government accountable to the Red Cross, UN and other international watchdog agencies. The status quo has the Obama administration continuing the secret detentions of its predecessor; a practice which is not reconcilable with a democratic society. As long as that is going on, we don't live in a democracy, because we simply cannot know that political prisoners are not being held.

I agree, we should be free to strip US citizens of their Miranda rights, and their right to a trial based on suspicion and arbitrary definitions. Constitution, hah who cares about that? Inalienable rights? Lol wat is that?
