Check our resolution in the UN, which everyone seems to be racing to vote against.

OOC: They can get extra soldiers pretty easy when you calculate that 5% of 10,000 is 500. Until they are recruiting over 500 armies per turn they are well within the rules.

Like any being with a built-in security mechanism, a Formatic can pretend to be sentient when survival depends on it. No different from when a sociopath in human society pretends to be kind and caring when it is prudent for them to.
