Oklahoma Senator under investigation for incident at motel with teen boy
MOORE, Okla. - Oklahoma Senator Ralph Shortey is under investigation for an incident at a motel with a teenage boy.Cleveland County District Attorney Greg Mashburn told NewsChannel 4 the boy is 16 or 17, and that is the age of consent in Oklahoma.

Shortey is 35. The incident took place at a Super 8 in Moore.
We’re told police are reviewing text messages between Senator Shortey and the teen to determine if anything criminal has occurred.

It was those text messages that led the boy's family to call police, according to Mashburn.
We do not know what was contained in those messages.
Police responded to a check welfare call at the Super 8 on Thursday, March 9th.
We're told the officers found a teen boy in the room with Senator Shortey.

I'm probably stereotyping Oklahomans, but I can't help wondering how much of this is just homophobia/gay panic. But even if there was no coercion or anything, I have to question the sense of a 35-yr-old politician who goes to a motel with a teenager. I mean, c'mon, dude.

Police are reviewing text messages between Senator Shortey and the teen. District Attorney Greg Mashburn says the texts led the teen's family to contact police. It's unclear what was in the messages or the nature of the texts.

Moore police recommended three-prostitution-related charges against Senator Shortey.
According to KOCO, the charges recommended for Republican Senator Ralph Shortey include soliciting prostitution of a minor, prostitution within 1,000 feet of a church and transporting for the purpose of prostitution.

Police were called for a welfare check at the motel on March 9th.
Police say, before entering the hotel room, they smelled “a strong odor of raw marijuana emitting from the hotel room.” After searching a backpack, police found an open box of condoms and lotion.

While not guaranteeing the pornography filmed is performed by consenting adults, it does at least provide for some evidence should exploitation or consent become relevant inquiries about the act of fornication in question.

The biggest thing preventing anyone and everyone interested in prostitution from merely placing a camera in front of them while they have sex is that pornographic films have a number of laws they must follow in order to comply with the law. You may need a business license, you will need the consent of all people who appear on camera, you need sufficent paperwork to prove that anyone on camera was over 18 and you need to show that all the people performing in the film were tested for STDs within the last 30 days.

If you fail to follow these laws, you could still be charged with prostitution as the prosecution may show you only filmed the act to attempt to skirt the law and had no intent to make an adult film or to express your first ammendment rights. You could also be charged with breaking these laws as well. In fact, if you didn’t tell the other party that you were filming the encounter, you could even be charged with wiretapping, which can be a felony crime. While you don’t want to get charged with prostitution or solicitation, getting charged with wiretapping and prostitution is a whole lot worse.

Whistleman admitted paying people to perform sexually on camera for a start-up Internet business. The law simply bans trading in sexual activity for "anything of value" and does not specify participation in the sex act.

Devanie acknowledged at sentencing that his client had violated that statute but said Whistleman did not realize paying actors to make pornography is illegal, because the porn industry is widespread. He argued the law is meant to ban street prostitution, but Horne said that his office would consistently enforce prostitution laws within the county.

It would explain the charges of Child prositution the police are charging him with.

At least the Republicans dropped him like a rock, instead of rallying around him.

Officers said they found the boy’s Kindle Fire tablet and obtained a search warrant for it. They said they found conversations between Shortey and the boy regarding sexual activities in exchange for money.
Police said Shortey and the boy told officers that they have known each other for about one year. They originally met through a Craigslist personal encounter ad, they said.

The child prostitution charges is because he is under age 18. Like I said, it's crazy that the law says he's not considered a minor to have sex, but he is considered a minor to get paid for sex.
