Cops want to force Boy to have an erection - for evidence

Both the police department and the city have been fielding irate calls from around the United States—and the world—since the story broke, the Associated Press reported. While the search warrant authorizing the photos had been issued, Manassas City Manager Patrick Pate said, Pate downplayed the possibility that the photos would ever have been taken.
I doubt the police would have refused hot boy cock if the public wasn't watching.

Is this a Fourth Amendment violation?

The Fourth prohibits unreasonable search and seizures where reasonableness is determined by a magistrate reviewing a search warrant request. Here a magistrate determined that it the warrant was reasonable. The reasonableness could be reviewed, however, and the Fourth Amendment argument would be that the warrant request was not reasonable. The warrant itself has a reasonable basis to be requested in that the police reasonably think that’s the kid’s dick, but the reasonableness of the manner of the search is questionable.

I’d be more interested in the Fifth Amendment ramifications. The Fifth protects against self-incrimination, generally interpreted as a right to not incriminate oneself through an obligatory statement. Certainly one can hypothesize a pattern of facts where an erection is a statement and therefore could not be compelled of a defendant.

A Thirteenth Amendment claim is also possible here. Unlikely, but possible.

JR, it is the cops that want to give the kid a chubby, not make the cops chubby.

^ Very first thing that popped into my mind upon reading the OP. I cannot believe this is even being considered.
Thanks for the chuckle.

This case is disgusting, perverted adults should stay out of teenagers sex lives unless lack of consent is present. This type of nonsense waters down the term sex offender.

The only thing this kid should say to anyone regarding this case is "The Virginia police department can suck my dick".

Thanks for the chuckle.
I was actually looking for a screenshot of them in the Principal's office when she's demanding he show her his johnson, but couldn't find it. Figured this would still convey the message. Glad you liked it :)

Yeah. I remembered. Great flick. Too bad the cable channels don't seem to want to show it much anymore.

On the bright side, after the dot-com bubble blew, nobody is putting e in front of everything (imagine, eCFC. *shudder*). However, I predict that in 45-50 years, neo or cyber will be the new fad.

All hail cyberCFC, anyone?

This story is completely ridiculous and not just because of teens suddenly becoming criminals for sexting. Or cops essentially producing child pornography themselves in order to get evidence for child pornography.

I was almost (almost!) hoping that this would happen, just so that the police would have to arrest themselves and presumably whatever idiot judge signed off on the warrant for producing kiddie porn.

My username, cybrxkhan, anticipates such a fad. :D

I'm certain they will exempt themselves from arrest for kiddie porn. That sounds like the kind of thing they would do.

Reminds me of a Supreme Court case years ago (or maybe it was a lower court, I don't remember) a friend of mine told me about where the judges had to go through a bunch of hentai (depicting underage folks?) to determine if it was obscene enough or something.

With provisions made for appropriate sex education I agree 100%

Generally get rid of this "teenagers are children" claptrap. Perhaps it'll also make teenagers better prepared for adulthood.

When I read this story in the paper, I really thought it was a joke, but then realized it wasn't April 1.
