Anyone know if its possible / how to get an official record of my browsing history?

And it's still their forum and they can ban you if they like, spam accounts or no spam accounts. Just move on.

I dont care about the ban, you seem to be missing the whole case of:

- Malicious falsehood
- Online libel
- Mass defamation (two websites where this false information was spammed and most people believed it)
- Online fraud (someone else having pretended to have been me, very minor case of this though).
- And maybe even framed as being the guilty party who made the false accounts?

What exactly is the case? A civil case requires damages that can be quantified: emotional damage has to be extremely severe to count on its own.

Mass defamation isnt a case?

Not in itself - you have to say 'as a result of this defamation, I lost so much money in business' or something of the sort, or 'as a result of this, I lost my ability to fill the elected office to which I had been elected/was standing', or else 'I am a sufficiently public figure that I suffered obvious public humiliation from this'. I don't see that having one's pseudonym 'defamed' on a forum qualifies as that. The monetary value of the damages is next to zero.

Incidentally I think you have a stumbling block here:

A. In both libel and slander cases, you need to prove that:

The allegations have been published to one or more persons (other than yourself)
The allegations refer to you – either that you are named, pictured or are identifiable in some other way
That the words tend to lower you in the eyes of right thinking members of society.

I am named as my username is identifiable as my real name, and also I posted pictures of myself under it?

It turns out it wouldnt be more that a return of the legal fees :(

Just waiting to see if a no win no fee thing is possible, otherwise I just leave it at the police web history search.

I dont know, its just meant to be an EU law that ISPs keep their customers last 6 months of web history, but mine claimed they dont, so I just need the tech department from the police to get it.

Righteous indignation is not the basis for winning. Move on. I for one will not think less of you for whatever the bad guy made it look like you did.

I agree, this is not something any court would actually take up. You should just move on and know that the forum cost itself a potential member by its actions.

The EU high court has ruled that this law was not rightful, because it infringed the european constitution regarding privacy, already last year.
They'd also have "only" stored the metadata (IIRC), and not what was actually happening, so that might not have helped you at all.

+1

If it makes you feel any better, bhavv, i decided to stop posting at the Paradox forums after a rather stupid action by very few posters there (and at least one mod). You can't win such things on the web, and you can just use a different site for pretty much the same thing.

Now, CFC admins: time to finally make me a mod here, or a supermod immediately :)

You live in the US. If you look at the links I posted they do take these cases on in the UK. Nothing wrong at all with sending the information to them and waiting for a reply to see what they will say.

'They', the lawyers, is not the same as 'they' the court. I'm sure the lawyers are happy enough to take your money, but whether a judge is prepared to use taxpayers' time to hear the case is another matter.

Well, you can always ask, but I don't think you're likely to come out ahead no matter what you do. Legal fees are steep and according to the website you linked their cases average a year and can go on longer. Even if there weren't a fee this would still be much more trouble than it's worth.

This sort of thing may be worth it if they spread disinformation about you that made it more difficult to get a job or something else that caused you actual financial damage, but not if they just wrongly banned you from a forum. Forums tend to take a very dim view of legal threats, too, so I can't imagine a legal threat would make them likely to reinstate you.

I'm not taking action for the ban or looking for reinstatement. I'm taking up action to clear myself of the accused offenses.
