I don't understand why you should have a problem with copyrighting. I thought that as long as you're not trying to make money off it, you could use copyrighted music. I don't think you intend on selling this mod, do you?
No, i don't want to sell it, but the music industry would not be happy about it.
It would be seen as piracy, because you can access every music file in Civ freely, so if i add some commercial song to the mod, everyone would have the song and no one would have to buy it.
As for anthems, I know the European Union has a lyriced version of the Ode to Joy as their 'national' anthem. Instrumental versions of the anthem would fit for the countries.
I'm not sure about that.
The song is very well recognizable and well known, it could be, that it more disturbes the atmosphere.

If you don't want to use copyrighted music for the anthems for the Private Space Explorers (you have to find a better short name for them. I mean, 'Privates' sounds silly), Jail Rock and Martians, you could find original music by independent artists. I know that the website Newgrounds has an excellent audio portal with music free to download of all genres. You could probably use some music there with the artist's permission. I have a few suggestions for themes from Newgrounds:
A People's Passion - Martians
Shinra Corporation - PSE
3 Shades of darkness - Jail Rock
But those are just recommendations. I think your best bet is to find music from independent artists if you're really afraid of legal action.

Looked at the songs, i like the Shinra corp, that's great.
Not sure about the People's Passion, i think i have to hear that a couple of times to decide.
Shades of Darkness would fit as ambient sound, not sure if it's okay for diplomay

I think the diplomacy music should be more dramatic than happy or sad. They should say, "yo, I'mma let you finish, but my civ's the best civ of all time! ALL TIME!" Ode to joy doesn't quite do that, whereas maybe Beethoven's 5th Symphony, III could work better. I'm all for using national anthems (the Israeli one is awesome) but things like the Salvadoran anthem don't work so well (five minutes/verse, and not much to be proud of).
I'm not that concerned about the attitude of the music. I even think that sad songs could fit very well.
It's more a thing of the overall style.
The songs have to be mainly instrumental, lyrics don't fit that well (besides main theme), and it should be overall futuristic. Every kind of electric music should do there very well. A theme itself in the music would be nice but is not really needed.
But electric music itself is not my taste normally, so i have even some problems when looking at the stiles >.<
Btw, with respect to the Private Space Explorers, I have a feeling The_J wanted to use the short term "Privates" for a reason

Anyway, I was thinking Martians could be something from "Mission to Mars" (2000). Jail Rock in theory could be "Jail House Rock" but it doesn't fit with the dramatic part. PSE could be something from a movie about space exploration
No intendation with "privates", no, that not. Theme itself fits good, so that's not really a "problem".
