Unauthorized access and all, but anything more than a fine seems insane. Surely 5 years in prison would cost the state quite a bit of money.

Does Michigan not have adultery laws still on the books? Seems to me the man was the innocent and the wife the guilty party of a crime here.

"The guy's a hacker," Oakland County Prosecutor Jessica Cooper told the Free Press. "[The email account] was password protected, he had wonderful skills, and was highly trained. Then he downloaded them and used them in a very contentious way," Cooper is quoted as saying.
I didn't know copying written down passwords was a hallmark of being a 1337 h4xx0r.

It's a life sentence in Michigan, iirc. Good luck seeing that hold up in court though.

This is insane. This is not the sort of thing that warrants imprisoning people.

He downloaded his wonderful computer hacking skills? Was this quote doctored?

This make me laugh very hard.

I dont think that these people know very much about computers if they think that copying down passwords left in a notebook beside the computer is using "wonderful skills" to "downloading them."

I think he meant he downloaded the emails, not his Computer Science III skills.

WHAT!??? This is like breaking in to someones diary that is locked. (or getting the code to unlock the phone of that one hot girl to see her nudes lol).

So what are the laws on reading someones private files??? I'm sure there are laws on the books already.

It's the spouse, WTH?

You mean like cheating on your spouse and letting your kid get abused?
Irrelevant to the crime at hand.

Also if the computer is jointly owned , its not criminal by law standards.
Joint ownership of the machine does not equal a joint right to access to the email account.

I own stock in a Fortune 500 company and thus jointly own every computer in the company. Can I have access to everything on all of them?

Michigan's adultery laws are no longer enforced. It is also worth noting that 90% of all counties have horrible legal systems

I have seen a mother go to jail for something the father did and the cops knew it. They just don't like the mother's new husband, so they went after her. The baby's father is known as the neighborhood child molester now.
