This will serve as the temporary judiciary until provolution returns from his "break"

Judge Advocate Ashburnham will be nominating a pro term chief justice soon, to be approved by me and president DaveShack.

Provolution will return on April 3rd(4 days from now)

And don't worry provo, we aren't as strict as you, we won't declare you absent

I want to file a JR to have something in the constitution clarified. Should I post it up now, or wait until Provolution gets back?

March 3rd is over 330 days away. Unless you meant April 3rd... ;)

How nice. Quite lovely to have a judiciary that will be fully cooperative and friendly.

Request for Judicial Review

Declarations of war fall under the purview of which office?

Relevant articles from the Constitution:
Code:
D. 4. Consul for External Policy - Oversees long term planning
of policy regarding other nations. This includes military
plans, long term foreign affairs, and long term trading
       goals.

E. 1. Commander of Armed Forces - Micromanages the military
operations against foreign countries and unit (excluding
worker, settler, and non-military transport) movements.

E. 2. Director of Commerce - Decides on foreign affairs and
trading. Sets exact tech queue. Manages budget. Adjusts
slider and approves/denies requests from leaders regarding
the use of gold. Also decides on espionage missions.

As we can see, the External Consul is responsible for long term plans relating to "foreign affairs" as well as "policy regarding other nations". Do declarations of war consist of long term plans?

The Director of Commerce "decides on foreign affairs". Wars are most certainly foreign affairs.

And the Commander of the Armed Forces is included since he/she manages the military might of our nation as well as "military operations against foreign countries". I believe war fits that definition.

So, seeing as Fanatannia will most likely be at war soon, who is in charge of deciding when that time has come? Furthermore, will peace negotiations and military alliances fall under the same jurisdiction?

it was a joke regentman, i fully support provo and ashburnham
and yeh its april 3rd...

Sadly, my efforts to find a pro-tem Chief Justice has proven unsuccessful. However, this is a blessing in disguise, as I'll be unable to get online until Sunday (the 3rd).

Consider the Judiciary on hold until the end of the weekend.

I'd be willing to be pro-term CJ, but this might seem a little out of line since I lost the CJ election.

On another note, I'm wondering if Provo will ahere to his strictness and file a CC against Term 1 Judiciary for overstepping legal bounds. ;) :p

I don't see why you can't continue in the role until Provo makes parole blackheart. I think it's just sensible for you to continue.

OT: I think that having the CJ in jail is great!

We arent overstepping term 1 bounds, I am the term 2 public defender. However ashburnham is also gone, thus there would be chaos if I found a pro term CJ and JA
and anyway ashburnham gets back in about 24 hours, so there would be no use to the pro terms

I would like to ask for a JR.
My interpretation of the constitution is that elected officers apply for funds in order to discharge their duties from the Director of Commerce and he either grants or denies that request.

Does this in effect mean that the commerce director can veto any action requiring gold?

I am currently proposing spending when and if necessary 10g +1gpt on a gift. This is the minimum hardcoded value in the game that will raise AI attitude toward us by the maximum hardcoded value in the game. I cannot spend less to achieve the same result. It appears that some people think that the commerce director can refuse the request for money, or stipulate some other sum. In effect this guy may as well just play the game and tell the rest of us how he got on if this is the case.

Any road up, I'd like a JR to clarify it thanks.

If it please the court, or even if it doesn't please the court ;), I would like to comment on the as yet unnumbered JR requested by mad-bax.

The commerce director is responsible for posting the instructions on use of funds and slider settings, but does not have the power to disregard or overrule consular plans. This is a difficult part of the law, I must agree, and while it seemed reasonable at the time it's probably not my best organizational effort, being too complicated. It was meant to model both an individual playing civ and an actual government deciding how to spend money.

The original intent is
  1. R&T decides on min / max science
  2. Domestic decides on lux slider policy and cash rush policy
  3. External decides on upgrade policy
  4. Consuls communicate and negotiate priorities. President mediates and arbitrates if necessary
  5. Commerce posts instructions which carry out the unified plan.

The first 4 steps should occur simultaneously and ahead of time and don't necessarily require specific knowledge of the save though it obviously helps. Step 5 is the one which is at question here, and it is clear that the intent is for the Commerce Director to carry out the plan in the best available manner given up to the moment information from the save.

Mad Bax, you need to post the Article in citation you want reviewed to follow protocol.
It does have merit from what I can see, but we need to do this by the rule.
Please post this in the new Judiciary thread.

LeeT911, I have reposted your JR, and will rule it out in the new thread.

Dave, I will look into the Amicus brief when the JR is posted

MOTH, you need to post the Naming Law details and possibly the matters you mentioned in the Strategic Override Poll.

For everyone, I will do my best to make this a fair, transparent and as neutral as possible court, however, I am very open to reforms if asked upon, and will not stall any moves to reform the constitution. I give this as a clear signal that I am ready to process called for reforms expediently.
