Really? Well not for you perhaps but I think that to use commonsense especially in situations when one is not certain is highly practical.

This is "moral is when you're moral" level thinking.

Again common sense is practical and simple "level" of thinking based on experience. Not much to contemplate really...

Well, consider in which situation someone would have to decide which sort of behavior is acceptable in public. There needs to be one party who behaved in a certain way, and another that objected to it for some reason. It's reasonable to assume that both of them acted according to "sound and prudent judgment based on a simple perception of the situation or facts".

How could that happen? Well, because "common sense" is a completely subjective and arbitrary concept that's completely meaningless in a legal judgment.

Any arbiter could agree with either of the parties or arrive at a completely different conclusion at random simply because of their own subjective idea of "common sense".
 
Doesnt word "common" imply something objective? Like in common consent or common good?
 
I'm no legal scholar but my view on the matter is an extrapolation of the principle of freedom of speech. FoS says that people have the right to say what they want; people DON'T have the right to not be offended. This is something that I think people very often forget, or overlook.

The difference between banning porn in public and prayer in public is that usually people don't pray with their genitals flailing about.

Because porn is an inaccurate representation of human sexuality and not a good introduction to the subject at all; it's bound to confuse our youngins.

Good explanation. Just as violence is not a correct representation of proper human behavior and interaction. Kids are much more vulnerable to such things, because they are still in the process of development and learning how to live in human society.

It's a totally inaccurate representation of human sexuality, like I said. It doesn't have to be weird german poo porn for it to be that - most porn is horribly inaccurate.

We're much better off instructing our kids in human sexuality by showing them videos of REAL sex. Mind you, in north america that will never happen, but maybe it should.

Well capacity and "right" to insult others are not the same thing. We all have the capacity but most of us refrain from it as it would mean violation of other codes which we value above this low form of free speech.

I of course do not go out of my way to insult anyone but carrot faced freaks, but it is a right I have in the sense that there is nothing you can legally do to prevent me from offending you.

My point is not that this is something we should all be doing; but rather that you do not have the right to not be offended at the things that I do, unless they are illegal in some way.
