A woman who breached an Asbo banning her from having noisy sex has been given a suspended prison sentence.

Caroline and Steve Cartwright's "unnatural" love-making prompted complaints from neighbours, a postman and a woman taking her child to school.

The 48-year-old, from Washington on Wearside, had earlier pleaded guilty to three counts of breaching the Asbo.

At Newcastle Crown Court, she was given eight weeks suspended for 12 months and a 12-month supervision order.

During a previous hearing, next door neighbour Rachel O'Connor told the court she was frequently late for work because she overslept having been kept awake most of the night.

She said: "The noise sounds like they are both in considerable pain. I cannot describe the noise. I have never ever heard anything like it."

In December, Cartwright, of Hall Road, lost an appeal against the Asbo and an earlier noise abatement order.

Passing sentence, Judge Beatrice Bolton said: "I've heard a very short extract of the noise you make and can well see that your neighbours would be upset and distressed by this.

"The difficulty here is that the first occurrence was the day following the order. Then three days later you breached it again.

"In addition it's quite clear from the small extract I heard that you made no attempt to silence yourself."

Ms Bolton warned Cartwright that if she committed further offences of the same nature, she would be sent to prison.

Is it right for the state to interfere in bedroom matters like this? Is the possibility of the prison just or too harsh?
 
They were not interfering with the bedroom activity. No different from a neighbor cranking a stereo at 2am. Noise ordinance violation, yo?

Police state not just yet but we on the path. I think this is justified, a child hearing that would be disturbed imo.
 
This is directly equivalent to police turning up to a party because they're banging out seventy decibels of gangster rap at three in the morning. Nothing to see here, move a long.

Answer in 2 parts:

1) YES, it is right for the State to interfere because the State must guarantee that its citizens do not piss off each other.
2) YES, jail is far, far, FAAAAR too hursh as a possibility. A good old fine is the way to go. If they repeat over and over, then jail might be needed...

Having loud sex is fine, if you don't mind your neighbours looking at you funny. Breaking a noise ordinance isn't fine. The woman's been warned repeatedly. She can invest in some sound proofing or shove a sock in her mouth.
 
Well when the postman contacts the police to say it sounds like something awful is happening and could they send a squad car to have a look, you do have to consider that you may be doing something rather wrong on your baby-making. I'm against ASBO's as undemocratic, but these punters have been complained against hundreds of times, and not just by some prissy old ladies.

ASBO = bad. These punters = bad.

Wow. I had to google ASBO, and then busking and flyposting. Good thing you chaps don't have a Minister of Silly Walks yet.

That said, this law could really come in handy controlling a lot of my redneck neighbors who frequently exhibit ASB, expecially on the weekends when they get drunk.
