I think his point was that A: it shouldn't be illegal or B: if that's illegal, so should discrimination against racists.
I'd concede the point if he thinks that employers shouldn't discriminate against people who committed crimes of moral turpitude for option B. Racism is a pretty clear indication of moral defect and so is a history of criminality.
