Judge delays Trump’s sentencing until after the election​



Former President Donald Trump will not be sentenced in his New York criminal case until after the 2024 election, Judge Juan Merchan announced on Friday.

Merchan wrote in a new letter that he would sentence Trump on November 26 – if necessary – in response to a request from Trump’s lawyers to push back the sentencing. Merchan noted the upcoming presidential election in his decision to delay sentencing, saying that part of his reason for doing so was to avoid the appearance that the sentencing was intended to influence the November election.

“Adjourning decision on the motion and sentencing, if such is required, should dispel any suggestion that the Court will have issued any decision or imposed sentence either to give an advantage to, or to create a disadvantage for, any political party and or any candidate for any office,” Merchan wrote.

In addition to pushing back the sentencing until November 26, Merchan wrote that he would decide on Trump’s motion to vacate the verdict because of the Supreme Court’s immunity decision on November 12, which is also after the election.

BJ, do you think Merchan would have done this if Trump's standing in the polls had not declined?
 
Though there is something to be said for treating Trump like the criminal he is and keeping him on a normal sentencing schedule, it is prudent to set sentencing for after the election. If I were the judge, I would have initially set it for one week after the election once the convictions came down.
 
I have no idea why a parent would allow that. There is just no upside. Can you imagine?

Despite the meme "Don't California Our Texas", most of the folks moving to Texas are more conservative.


In 2013, the Texas Tribune and UT Austin conducted a poll surveying the political orientation of California expats. The California arrivals were 57 percent conservative compared to 27 percent liberal. “OK,” one might expect Texans to respond skeptically, “But what about the others?”

In a 2018 exit poll in the hard-fought U.S. Senate race between Sen. Ted Cruz (who had moved to Texas) and then-Rep. Beto O’Rourke (a Texas native), natives preferred O’Rourke by plus-3 points whereas movers favored Cruz by plus 15. Cruz won the race by 2.6 percent, meaning that if it were up to people who were Texans by birth, Cruz would have lost reelection.
When looking at where the movers to Texas came from, patterns emerge. Movers from other states were about 1 percent more likely to have voted for Trump than were natives, while movers from overseas favored Biden by 9 percent over natives.


Among domestic migrants to Texas, Trump was most heavily favored by arrivals from the Mountain West, where Trump enjoyed a plus 13-point margin over the support of native Texans followed by the four-state region of Alabama, Kentucky, Mississippi, and Tennessee with a plus-8 advantage. Counterintuitively — at least among Texans with an opinion — the area with the third-highest support for Trump among movers was California, where movers were 5 percent more likely to have supported Trump than were natives.


The region that sent the greatest share of Biden supporters was the South Atlantic Seaboard region, where movers favored Biden over Trump by 9 points more than did natives — the same margin as Biden was favored among voters who were born in another country.

No, I think he did it because any fair sentence would set off a firestorm. The judge was in an impossible position. Polls are not the issue. His delay looks political (pro Trump) but any sentence, jail or no jail, will also look political. I agree with @JollyRoger that sooner after the election would be better. My hope was for a 1 year jail sentence in Rikers beginning immediately. :(

I think the charges were brought in good faith by the prosecutors and see no reason why they should let up because Trump is confirmed a loser. He still is a habitual lawbreaker. To me, the Florida case is the one he should really be nailed on.

Former 2024 Independent presidential candidate Robert F. Kennedy Jr. reportedly won his appeals to be removed from the ballots of North Carolina and Michigan on Friday.

In fact that should definitely add some votes.

Trump has spent 2 years delaying his legal issues in hopes that he can dismiss them when he is re-elected. If he loses in November, the cases will all likely proceed and the "dogpiling" effect will be caused by his no longer having the juice to delay them further. Trump created this scenario. For him it is an all or nothing, win-lose situation regarding the federal cases. If he wins, he will make them all go away. If he loses, they all will roll ahead to his demise.

Have you noticed that the GOP no longer cares about Hunter Biden? With Joe out of the race Hunter is now irrelevant. Smells very political. If Trump loses, I expect all his cases to keep moving ahead until juries decide he is guilty or innocent .

Harris' margin of victory in both EC and PV will
effect sentencing. It's already true, today, in NY state that only the perception of Trump's power gets the judges generosity. He has no actual power.

At nearly every point, the people in positions of power have maintained a double standard for Trump. His movement would really need to show it has little popular support for the "defenders of the law" to actually act. Been a pattern past 8 years.
 
It is unclear which.
It is very clear: Trump gets a temporary win in that a tough sentence (jail time) would not help his campaign. How could this delay help Harris?
 
So Trump can win carrying Pennsylvania and Georgia assuming he retain the other states?

He's gone burger if he doesn't win Pennsylvania and it's a lot harder for Harris if she doesn't win.

illegal immigrants are banned from voting by federal law. new york allows noncitizens, i believe. texas? nope.
