I feel bad for stealing it from under the nose of all those that guesses first, while I just scrolled past.
Solving these is a team effort where one can buld on what others have asked or guessed. :)

Our of the three serious ones I considered, I went with the following one. Blue is different from the other categories and grey is NOT not applicable. Hope that is cryptic enough.

Since blue is different, if I ignore it, are the other colors political in nature?

everything is political, so I'd say yes. (but most would say no)

higher, but the scale is uneven

The colour map is not very intuitive, so I guess it's not a scale?

It is, but blue and grey are special colours outside the scale
 
Vermont is the only US state in the grey class. If only I knew more about US states that would probably help.
 
I'm trying to imagine what Texas, California, New York, Illinois, and North Carolina have in common only with each other but not coming up with anything. My familiarity with US states is certainly not sufficient.

If you take out North Carolina for a moment there, what these states have in common is very obvious and is what makes this map informative, though not necessarily helpful.

I guess I better just give the scale, as I‘m not entirely sure how they got to that scale themselves :) From Top to bottom:

1-2 cases
3-5 cases
6-10 cases
11-20 cases
21 and more cases
Blue = no cases, but there have been in the past
Grey = no cases, and there never have been
 
Mass shootings?
