Because the litmus test for gerrymandering is if it is done explicitly to disenfranchise a minority. If it is officially done to marginalize the political opposition then that is allowed.How do such tremendously obvious things get approved?
Of course by going after Democrats, they end up going after people of color and marganilizing them. But so far their legal defense (We're out to get Dems, not blacks!) has held up in court ruling after court ruling.
There are also instances where minority groups actively participated in or otherwise blessed the gerrymandering of their own districts in order to ensure that minority communities would have minority congresspeople.
